The present Chamber Order is e-filed by the applicant for setting aside Order dated 20.07.2023, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Perused Chamber Order and Affidavit in Support to the Chamber Order. The petitioner stated that due to personal difficulty, health issues of his Advocate and as he could not arrange money for the court fees within time, the captioned petition got rejected for noncompliance of office objections. The petitioner is a super senior citizen of 71 years and he has properly explained delay of 319 days caused in filing present Chamber Order in his Affidavit. In view thereof, I find no obstacle in allowing present Chamber Order. Considering fact that the applicant is a super senior citizen, and aforesaid reasons, prevented him from getting office objections removed within time, one opportunity needs to be given to the applicant to pursue with the captioned Petition.

For the forgoing reasons, delay of 319 days caused in filing present Chamber Order is condoned and Order dated 20.07.2023, whereby and whereunder, captioned Petition got rejected, is set aside. Accordingly, the present Chamber Order is allowed as prayed and captioned Petition is restored to file.
