CHOL/396/2025 IN ARBP(L)/21009/2023 Mr. Pavanaj Hariharan, Advocate for Defendant No. 1 P.C. : The present Chamber Order is e-filed by the Applicant for restoration of the Petition and setting aside Order dated 11.09.2024, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Affidavit of Service showing service of Chamber Order upon other side is already e-filed. Today, Ld. Advocate for Defendant No. 1 is present.

Heard Ld. Advocate for the Applicant. Perused Affidavit in Support to the Chamber Order. It is contended that the Applicant was in process of removing office objections on the Petition.

However, due to miscommunication between the erstwhile Advocate and the Applicant, who was residing at Uttar Pradesh, some minor office objections remained to be complied with.

Ld. Advocate for the Applicant submits that he will pursue with the caption Petition diligently, if Chamber Order is granted.

Ld. Advocate for Defendant No. 1 submits that appropriate order may be passed.

Considering reasons, as above, it transpires that the Applicant had made attempts to remove office objections. Therefore, in my opinion, one opportunity is required to be given to the Applicant to pursue with the captioned Petition. Therefore, present Chamber Order is granted as prayed subject ....2
