Ms. Akanksha Shukla, Advocate for Respondent ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) P.C. : The present Chamber Order is e-filed by the applicant for setting aside Order dated 13.02.2024, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Ld. Advocate for the applicant submits that the respondents were served with the Chamber Order as per Affidavit of Service, which is already e-filed. Heard Ld. Advocate for the Applicant. Perused Affidavit of the applicant. It is contended that the Advocate failed to attend the matter on 13.02.2024 when the matter was listed before this Authority and office objections remained to be complied with by the Petitioner. It is further contended that for the same reason, delay of 152 days was caused in filing present Chamber Order. Ld. Advocate for the applicant submits that now, he will pursue captioned Petition diligently and therefore, prays that delay caused in filing present Chamber Order may be condoned and Chamber Order may be allowed.

Ld. Advocate for the Respondent submits that appropriate order may be passed.

Reason mentioned in the Affidavit-in-Support appears to be bonafide, and substantial justice cannot be denied on technical ground. In view thereof, delay of 152 days, caused in filing present Chamber Order, is condoned and the present Chamber Order is granted as prayed.
