The present Chamber Order is taken out by the applicant for setting aside Order dated 13.03.2024, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Ld. Advocate for the applicant submits that respondents were served with the Chamber Order as per Affidavits of Service, which are on record. Despite service, none appeared for and on behalf of the respondents, save and except, respondent no. 1.

Heard ld. Advocate for the applicant. Perused Affidavit in Support to the Chamber Order. It is contended that Advocate on record lost the track of the matter due to which clerk of Advocate could not remove office objections within stipulated time. It is further contended that for the same reason, delay of 93 days caused in filing present Chamber Order, which was not intentional. It also contended that the applicant wants to withdraw the captioned Petition once it is restored to file.

Ld. Advocate appearing for respondent no. 1 objects the restoration of captioned Petition, however, submits for passing suitable orders. Considering reasons as stated supra, the present Chamber Order needs to be considered favourably.

In view thereof, delay of 93 days, caused in filing present Chamber Order, is condoned and the present Chamber Order is granted as prayed and signed separately.

The petitioner to remove office objections on the Petition and get the same registered and/or numbered within two weeks from the date of uploading of order, failing Petition to stand rejected for non-compliance of office objections under O.S.Rule 986.
