The present Chamber Order is e-filed by the applicant for setting aside Order dated 15.06.2023, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.
Heard ld. Advocate for the applicant. Perused Affidavit and Additional Affidavit in Support of the Chamber Order, contents of which are selfexplanatory. It is averred that at the relevant time, the applicant had gone to her native place, so also, she could not arrange court fees within time. It is averred in Additional Affidavit that wife of Advocate on record was under medical treatment since she suffered with mild stroke due to which delay of 406 days was caused in filing present Chamber. It is, therefore, prayed that captioned Petition may be restored to file by condoning delay, as above.
Reasons mentioned, on oath, appear to be genuine and therefore, I am of the view that the applicant should get one opportunity to pursue with the captioned Petition. Hence, delay of 406 days, caused in filing present Chamber Order, is condonded and the present Chamber Order is granted as prayed.
The petitioner to remove office objections on the Petition and get the same numbered and/ or registered within four weeks from the date of uploading of order, failing Petition to stand rejected for non-compliance of O.S.Rule 986.
