P. C. : 1. The present Chamber Order is taken out to delete the legal heir from paragraph - 4 of the Petition, as per the Schedule annexed to the Chamber Order.

2. Perused Schedule. The Applicant is seeking permission to delete the name of the legal heir, Ira Roy, Unmarried daughter of the deceased from paragraph - 4 of the Petition. The Chamber Order is supported by the death certificate of Unmarried daughter viz. Ira Roy, died on 05.06.2024.

3. The Ld. Advocate for the Petitioner submits that the present Chamber Order is in time and, therefore, the same be allowed in terms of Schedule annexed to the Chamber Order.

4. Perused the Affidavit dated 18.06.2024 annexed to the Chamber Order. In para - 1 of the said Affidavit, it is stated that during the pendency of the Petition, the unmarried daughter of the deceased, Ira Roy died on 05.06.2024.

5. Considering the nature of amendment prayed, does not change the nature and character of the Testamentary Petition.

6. Hence, for the reason stated in Affidavit in support dated 18th June, 2024 annexed to the Chamber Order and the submission made by the Ld. Advocate for the Applicant, the present Chamber Order is granted and the same is signed separately.

7. The amendments as per the Schedule annexed to the Chamber Order to be carried out within a period of four weeks from the date of uploading of the order.
