The present Chamber Order is filed for restoration of captioned Suit.

During course of hearing, ld. Advocate submitted that valuation shown in the plaint is less than Rs. 10 crores and therefore, this Chamber Order is not maintainable before this Authority and appropriate proceedings needs to be filed before the Bombay City Civil Court. Due to enhancement of pecuniary jurisdiction of Bombay City Civil Court vide The Bombay City Civil Court (Amendment) Act, 2023 r/w.

Notification No. CCS-2923/CR1/D-19 dated 16th January 2024, present Chamber Order is required to be entertained and tried by the City Civil Court.

In view thereof, the present Chamber Order filed in captioned Suit, does not survive and therefore, disposed of accordingly.

The plaintiff/applicant is at liberty to move before the Bombay City Civil Court for the said relief, as prayed under the present Chamber order, in accordance with law and subject to law of limitation.
