Mr. Swaraj Jadhav, Advocate for Applicant Ms. Sheetal Malvankar, Advocate for Respondent No. 1 (State of Maharashtra) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) ) P.C.: The present Chamber Order is taken out by the applicant for setting aside Order dated 18.03.2024, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.
Ld. Advocate for the applicant submits that respondents were served with the Chamber Order as per Affidavit of Service, which is on record. Despite service, none appeared for and on behalf of the respondents, except Respondent No. 1.
Heard ld. Advocate for the applicants. Perused Affidavit in Support and Additional Affidavit in support of the Chamber Order. It is contended in Additional Affidavit that the documents annexed to the Org. Petition were either illegible or required to be translated. It is further stated that Applicant took immediate steps to get the translation done, however, it took long time and Petition came to be rejected. It is further stated that firstly, the translation work was done inaccurately and hence, again another translator was approached. In view of the said inadvertent circumstances, delay of 200 days was caused in filing present Chamber Order. Ld. Advocate for the Applicant submits that he will pursue with the captioned Petition diligently if it is restored to file.
Ld. Advocate for the Respondent No. 1 submits that appropriate order may be passed.
Considering reasons, as above, it transpires that the applicant had made attempts to remove office .... 2

) ) ) ) ) ) ) ) ) ) ) ) ) ) objections, and he is in process of removing office objections. Therefore, in my opinion, one opportunity is required to be given to the applicant to pursue with the captioned Petition.
In view thereof, present Chamber Order is granted as prayed and signed separately.
The petitioner to remove office objections on the Petition and get the same registered and/or numbered within four weeks from the date of uploading of order, failing Petition to stand rejected for non-compliance of office objections under O.S.Rule 986.
