The present Chamber Order is e-filed by the applicant for setting aside Order dated 13.07.2023, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Perused Chamber Order and Affidavit in Support of the Chamber Order. Heard ld. Advocate appearing for the applicant. It is contended in Affidavit that due to miscommunication between Advocate and his clerk, office objections could not be removed within given time. Ld. Advocate submits that as on date, captioned Petition is uncontested and he will pursue with the captioned Petition diligently if it is restored to file. Ld. Advocate fairly admits that there is considerable delay of 258 days, caused in filing present Chamber Order, which was unintentional, for which the applicant is ready to pay costs of Rs. 1,000/- to Maharashtra State Legal Services Authority. I am satisfied with the submissions and reasons mentioned in Affidavit in Support of Chamber Order. Hence, delay of 258 days, caused in filing present Chamber Order is condoned subject to payment of costs of Rs.

1,000/- to the Maharashtra State Legal Services Authority within two weeks from the date of uploading of Order. The Chamber Order is granted as prayed.

The petitioner to remove office objections on the Petit228ion and get the same registered and/or numbered within four weeks from the date of payment of costs, failing Petition to stand rejected for non-compliance of office objections under O.S.Rule 986.
