The present Chamber Order is taken out by the applicant for setting aside Order dated 26.02.2024, rejecting captioned Petition under O.S.Rule 986 for non-compliance of office objections.

Ld. Advocate for the applicant tenders two Affidavits of Service, showing service of Chamber Order upon respondents, which are taken on record. Despite service, none appeared for the respondents.

Perused Affidavit in Support. Heard ld. Advocate for the applicant. It is contended in Affidavit that Advocate on record is not attending court regularly after June 2023 due to his health issues. It is further contended that Advocate has misplaced the papers of Writ Petition during shifting of his office and therefore, he could not take steps to remove office objections. It is further contended that for the same reason, delay of 215 days caused in filing present Chamber Order, which was not intentional. Lastly, it is contended that typed pages are ready to be replaced and it is prayed that captioned Petition may be restored to file.

Contentions raised in Affidavit, remain uncontested for want of resistance on the part of respondents. Therefore, I do not hesitate to rely on aforesaid contentions to hold that the applicant has made out a case for restoration of captioned Petition.

Hence, delay of 215 days caused in present Chamber Order is condoned and the present Chamber Order is granted as prayed and signed separately.
