Mr.Alai, learned Counsel, appears for the Insolvent and submits that only with respect to prayer clause (a) he is pressing this AVK 1/2

15-NMIS-15-2024.doc Application as the other prayers have become infructuous. The said prayer clause (a) is usefully quoted as under : "(a) This Hon'ble Court may be pleased to ipso facto permit and continue the Applicant (Insolvent) to take up and continue consultancy work with M/s.Danube Group for gain during the course of insolvency."

Since there is no response from the Official Assignee on this Notice of Motion, let the Official Assignee place before this Court a response to the aforesaid prayer clause (a) as well as the conditions that may have to be imposed in the event this Court considers it appropriate to allow the Application in terms of the said prayer clause. 4.

The Official Assignee also to issue notice to M/s.Danube Group to remain present through a duly appointed Advocate and inform this Court about the present state of the offer and the terms and conditions of the engagement.
