The Court Receiver has filed the instant Report towards compliance with the Order dated 14th December, 2023. Paragraph 4 of the consent terms filed between the parties contemplated Court Receiver to takeover possession of the suit flat from Defendant Nos. 1, 5 and 6 and to handover the same to the Plaintiff. The Report indicates that the Court Receiver visited the suit flat on 4th January, 2024, took over peaceful and vacant possession of the suit flat from Defendant Nos. 1, 5 and 6 and has handover possession thereof to the Plaintiff.

Learned counsel appearing for the Plaintiff confirms the said position.

In that view of the matter, the Court Receiver is discharged without accounts. The costs incidental to Court Receiver's Report are fixed at Rs.5,000/-. The Court Receiver to recover the costs, charges and expenses as well as the costs of GANESH SUBHASH LOKHANDE Rs.5,000/- of this report from the funds available with the Court Receiver.
