By an order dated 20th December 2023, this Court inter alia directed the Court Receiver to take possession of 37 commercial vehicles which had been hypothecated to the Petitioner and were in possession of the Respondents.

Today, the Court Receiver has filed a report being Court Receiver's Report No. 204 of 2024 in which the Court has set out that the possession of all 37 hypothecated commercial vehicles has since been taken by the Court Receiver and handed over to the Petitioner, the Court Receiver seeks the following reliefs:
3-CRR-204-2024.DOC "(a) The Hon'ble Court may please to discharge the Court Receiver, High Court, Bombay without passing accounts subject to payment of costs charges and expenses from the suit account because of compliance of the order of the Hon'ble Court.
(b) The costs of this report be awarded in the sum of Rs.5,000/- and the same should be debited from the funds available in the suit account."

Learned Counsel appearing for the Petitioner confirmed that all the 37 hypothecated commercial vehicles were handed over to the Petitioner.

In view thereof, nothing survives in the Court Receiver's Report and the same is allowed in terms of prayer clauses (a) and (b), reproduced above.
