ORDER :

By Court Receiver's Report directions have been sought for discharge of the Court Receiver without passing of accounts and upon deposit of Rs.37,600/- towards the costs, charges and expenses of Court Receiver.

The Court Receiver Report is taken out in the disposed of 1/3
Suit which had been disposed of by order dated 2nd May, 2018. By the prior ad-interim order dated 11th April, 2018, the Court Receiver had been appointed and pursuant thereto the Court Receiver visited the premises of Defendant Nos.2 and 3 at the addresses mentioned in paragraph 2 of the Court Receiver's Report and found the impugned products and prepared inventory and sealed the same. The Court Receiver had accordingly incurred costs for the execution of the exparte ad-interim Order.

Mr. Bhagat the learned Counsel appearing for the Plaintiff states on instructions that the Plaintiff has no objection for the Court Receiver being discharged upon payment of costs, charges and expenses which shall be borne by the Plaintiff. 4.
In view thereof, the following Order is passed:- (i) The Court Receiver is discharged without passing of accounts and upon payment of Rs.37,600/- towards costs, charges and expenses of the Court Receiver which shall be paid by the Plaintiff within a period of one week from today. 2/3
(ii) The costs of the Court Receiver's Report fixed at Rs.5,000/- shall also be paid by the Plaintiff within a period of one week from today.
(iii) The Court Receiver's Report is accordingly disposed of. [ R.I. CHAGLA J. ] 3/3
