Learned counsel for the applicant/plaintiff has today tendered Consent Terms by which she submits that the plaintiff and the defendant have resolved the dispute in the captioned Commercial IP Suit. She points out that the execution of the Consent Terms is duly supported by the report of the Affirming Officer which inter alia read thus: "The consent terms are duly signed by the Authorized signatories of Plaintiff and Defendant as above. The parties have admitted the Amk

2/2 3-comipl 31621-24.doc contents of the Consent Terms. The Consent Terms are duly signed by the parties out of their free will without any undue influence and coercion. The Consent Terms are duly executed by the signatories." 2.

Having due regard to the fact that the execution of the Consent Terms has been duly verified. The Consent Terms are taken on record and marked 'X' for identification. The undertakings in the Consent Terms are accepted as an undertaking given to the Court. Learned counsel for the plaintiff undertakes to pay all the necessary costs, charges and expenses of the Court Receiver. The offending products, if any, in question shall be destroyed in the manner set out in the Consent Terms. The Court Receiver shall thereafter stand discharged without passing of accounts. 3.

The Suit is disposed of in terms of the Consent Terms. 4.

Refund of Court fees, if any, as per rules.

All the Interim Applications and Leave Petition are disposed of. 6.
