Pursuant to the order dated 30th August 2024, today when the matter is called out, Mr. Carvalho, learned Counsel, appears for the Official Liquidator and submits that as directed by this Court, the Noticees have once again been given notice of today's hearing on 4th October 2024, however, none appears.

It is observed from the order dated 30th August 2024 that notices had been served upon noticees on 27th August 2024 and even on that day, none had appeared.

Ms. Temkar, learned Counsel appearing for the Noticee No.3 who is the Petitioner submits that the Noticee No.3 has no objection if the report is allowed as prayed for.

Accordingly, this Court has perused the Official Liquidator's Report and is of the view that the Official Liquidator's Report be allowed in terms of prayer clauses (a) and (b), which read thus : (a) In view of the averments made in paragraph

(7) of the report, whether this Hon'ble Court, would be pleased to direct FPCC to pay dividend to Official Liquidator of Amidtown Insurances Services Pvt. Ltd. from the year 2012-2013 till date for the years for which the dividend was declared.

(b) In view of the averments made in paragraph

(12) of the report, whether this Hon'ble Court would be pleased to permit Official Liquidator to appoint Panel Valuer / Chartered Accountant to prepare valuation of 1,31,204 equity shares of The Freyssinet Prestressed Concrete Co. Ltd. held by the Company (In Liquidation) and permit Official Liquidator to pay professional fees of Valuer / Chartered Accountant, after deduction of applicable taxes, out of the funds available to the credit of the Company (In Liquidation).

The Official Liquidator's Report is allowed and disposed as above.
