Learned Counsel for the Applicant submits that it is now apparent that on April 2, 2025, the Adjudicating Authority under the Insolvency and Bankruptcy Code, 2016 ("IBC") has referred the Respondent to Corporate Insolvency Resolution Process ("CIRP") under the IBC. Consequently, the institution and continuation of any proceedings against the Respondent would not be possible owing to the application of moratorium under Section 14 of the IBC. 2.
