By way of a praecipe, a request was made for speaking to the minutes of the Order dated July 8, 2025, to correct errors. The matter was reviewed and this order is passed.

The parties have mutually consented to record that they were also involved in disputes covered by Commercial Suit (L) No. 100234 of 2022 before the Learned City Civil Court, Mumbai in respect of the very same Leave and License Agreement dated August 31, 2018, which is the agreement underlying the Section 11 Application.

The Suit had been instituted by the Respondent while the Applicant had invoked Section 8 of the Act, which led to an order dated January 29, October 16, 2025

The said order has been upheld by a Learned Single Judge of this Court by judgment dated September 26, 2024 in Writ Petition No. 4193 of 2024. By an order dated May 7, 2025, the Supreme Court has dismissed a Special Leave Petition (Civil) No. 29044 of 2024. Therefore, the parties have consented to record that the Plaint in Commercial Suit filed by the Respondent would be treated as the claim pursued by the Respondent in the arbitral proceedings and the arbitrator so appointed would deal with the same in the course of the arbitration proceedings. The aforesaid joint statement by the parties is taken on record and this order may also be transmitted to the Learned Arbitral Tribunal appointed pursuant to the order dated July 8, 2025. 4.

The praecipe stands disposed of.
