Respondent WITH CONTEMPT PETITION (L) NO.344 OF 2025 WITH CONTEMPT PETITION (L) NO.35130 OF 2024 IN COMM. ARBITRATION PETITION NO.360 OF 2024 WITH CONTEMPT PETITION NO.1 OF 2025 IN COMM. ARBITRATION PETITION NO. 365 OF 2024 WITH CONTEMPT PETITION NO. 10 OF 2025 Mr. Kunal Vaishnav a/w Mr. Vijeet Trivedi i/b Ganesh and Co, for Petitioners.
Mr. Amitesh Singh i/b Devendra Singh, for Respondent. Mr. Manan Dixit, respondent is present through VC. CORAM: BHARATI DANGRE, J.
DATED : 6th NOVEMBER 2025 P.C:- 1.
The Roznama in the contempt proceedings record that repeated opportunities are given to the contemnor to ensure compliance of the undertaking, and the last order dated
2/3 50 CPCD9-25.doc 16/10/2025 clearly records this.
The order specifically states that a last chance is afforded to the contemnor so as to enable purging of the contempt, and a deadline of 31/10/2025 is set out for earmarking the fund in respect of the directions to be complied with, with a clear understanding that if no compliance is effected, appropriate action for contempt of Court would follow.
2.
That is how, these proceedings are listed before me. Despite a clear direction that if there is no compliance, the contemnor shall remain present physically in the Court, Mr. Dixit has marked his appearance online.
Even if this is to be condoned, he merely states that there was some proposal extended to the petitioners, but the counsel for the petitioner deny that there was any proposal extended in writing.
However, taking it as a bona fide attempt to make an offer, which, if accepted by the petitioner, would result into an amicable settlement, he states that though the proposal was never communicated in writing, he shall take necessary steps to communicate the proposal in writing either to the party or to the Advocates appearing for the petitioners.
Upon due deliberation, either an amicable settlement is arrived at and the contempt is purged, or else the contemnor shall remain present in this Court on 27/11/2025.
3/3 50 CPCD9-25.doc 3.
Let the proposal be exchanged within a period of one week from today, so that it can be duly deliberated. ( SMT. BHARATI DANGRE, J.)
