Mr Karl Tamboly, with Chitra Rentala, Anuj Desai, Advait Shukla & Parikshith Kejhkekara, i/b Trilegal, for the Petitioner. Mr Sarosh Bharucha, with Onkar Savarkar, Vaibhav Warerkar & Avi Kshirsagar, i/b M Mulla Associates, for Respondents Nos. 1 & 2.

CORAM:

ARIF S. DOCTOR, J SHEPHALI SANJAY MORMARE DATED:

9th September 2024 PC:- by SHEPHALI SANJAY MORMARE Date: 2024.09.10 14:07:21 +0530 1.

The matter was stood over today since on the previous occasion parties intimate the Court that there was a possibility of amicable settlement. The Petitioner has filed a Petition for recovery of certain monies advanced for the film. It is not necessary to go into the rival contentions since today there have been steps taken towards reaching this amicable settlement.

2.

Mr Tamboly only requests that the proposal for settlement is to be given in writing. Mr Bharucha, Learned Counsel appearing on

23-CARBP-261-2024.DOC behalf of Respondents Nos. 1 and 2 submits that the statement that the business of the Respondent firm be now assigned/transferred to a Private Limited Company named Planet Marathi Seller Services Pvt Ltd and the Petitioner would then to be inducted as a shareholder in the company. It is his contention that this proposal for settlement was in fact even discussed between the parties.

3.

Hence, in my view, since some disputes as to this proposed mode of settlement, it is requested that the Respondent give in writing to the Petitioner what exactly the settlement is. Mr Bharucha submits that this shall be done on or before 13th September 2024. 4.

List the matter on 24th September 2024.

5.

Earlier order, if any, to continue until the next date. (ARIF S. DOCTOR, J)
