Learned counsel for the parties consent to the appointment of Mr.Rushabh M. Sheth to act as sole Arbitrator in place of Mr.Vyom Shah, who was appointed by consent of the parties vide the order dated 14th November, 2025. The details of Mr.Rushabh M. Sheth are as follows :- 1/3

Upon a copy of this order being communicated to Mr.Sheth by the learned counsel appearing on behalf of Petitioner within a period of two weeks, learned Arbitrator shall file the statutory statement of disclosure under Section 11(8) read with Section 12(1) of the Arbitration & Conciliation Act. 3.

The parties shall appear before the learned Arbitrator on the date and place as intimated by him to obtain appropriate directions with regard to conduct of the arbitration fixing the schedule of pleadings and examination of the witnesses, if any, at the hearing.

Learned counsel for the Respondents submits that he shall intimate the learned counsel for the Plaintiffs the location of the five vehicles in question. Furthermore he submits that the Respondents seek to take out an application for variation / modification of the order dated 12th August, 2024. It is clarified 2/3

that if any such application is filed, the same shall be considered and heard by the learned Arbitrator.

Mr.Shekhar, learned counsel appearing on behalf of the Respondents assures the Court that the location of the five vehicles shall be given. Statement is accepted as given to this Court.

The Commercial Arbitration Petition is accordingly disposed of.
