Since an Arbitral Tribunal has already been appointed, nothing survives in this Petition. Liberty is granted to pursue proceedings under Section 17 of the Arbitration and Conciliation Act, 1996, before the Learned Arbitral Tribunal, which is already seized of the matter. Therefore, this Petition is finally disposed of.

Since no action has been taken despite appointment of the Court Receiver, the Court Receiver stands discharged without the need for passing of accounts, and subject to payment of applicable fees by the Petitioner. 3.
The Petitioner has liberty to seek such reliefs as it desires from the Learned Arbitral Tribunal instead.
