Mr. Punalekar, the learned counsel appearing for the RespondentBank would place on record copy of order dated 2 September 2025 passed by the National Company Law Tribunal, Mumbai in support of his contention that Corporate Insolvency Resolution Proceedings have been initiated qua the Petitioner. By the order, the Company Petition has been admitted and a Insolvency Resolution Professional has been appointed. According to him Respondent-Bank has a 40% share amongst the Committee of Creditors. He would therefore submit that the present Petition is not maintainable as the Respondent-Bank is not willing to permit the Resolution Professional to prosecute in the present Petition. 2.
