This Petition has been filed under Sections 14 and 15 of the Arbitration and Conciliation Act, 1996 ("the Act"). 2.

Learned Counsel for the parties have reached consensus on disposing of the matter by constituting a new three-member arbitral tribunal. Learned Counsel for the Petitioner has submitted that the nominee arbitrator on behalf of the Petitioner shall be Mr. Swannad Ganoo, a Learned Advocate of this Court. Learned Counsel for the Respondent submits that within one week from today, the Respondent shall intimate his nominee arbitrator to the Petitioner. Needless to say, nothing contained in this order is an expression of an opinion on merits of the matter or the relative strength of the parties. All issues on merits are expressly kept open to be agitated before the arbitral tribunal appointed hereby. 5.

All actions required to be taken pursuant to this order shall be taken upon receipt of a downloaded copy as available on this Court's website.
