Learned Counsel for the parties jointly submit that in terms of Consent Terms dated April 23, 2025 disputes and differences covered by Commercial Arbitration Petition No.117 of 2025 have been settled. It is pointed out that the terms of settlement would also render infructuous, the Commercial Arbitration Petition No.425 of 2024, which is also listed today.

A copy of the Consent Terms are taken on record and marked 'X' for identification. Parties confirm that there is nothing in these Digitally signed by AARTI GAJANAN PALKAR Date:

4.CARBP.117.2025.doc Consent Terms that is contrary in law. All undertakings contained in these Consent Terms shall be treated as undertakings given to this Court.

One of the terms of the settlement is that Commercial Arbitration Petition No.425 of 2024 shall remain pending until October 9, 2025, since all the sums due under the Consent Terms are to be received by that date. The parties are at liberty to inform the Court about the same and withdraw the Petition within three working days after receipt of such payment. In these circumstances, Commercial Arbitration Petition No.117 of 2025 is finally disposed of. 4.
Commercial Arbitration Petition No.425 of 2024 is stood over to October 9, 2025. However, it is made clear that the disputes and differences under all the proceedings stand settled in terms of the Consent Terms.

All actions required to be taken pursuant to this order, shall be taken upon receipt of a downloaded copy as available on this Court's website.
