Mr. Nair, learned counsel appearing on behalf of the Petitioner today points out that Co-ordinate Bench of this Court (Sandeep V. Marne J.) has on 7 th April, 2026 passed an order in an Application filed under Section 11 of the Arbitration and Conciliation Act, 1996, appointing Ms. Megha Chandra to act as Arbitrator in the disputes between the Petitioner and the Respondent. 2.

It is thus the contention of learned counsel for the Petitioner that the Petitioner be permitted to convert the captioned Petition, which is filed under Section 9 of the Arbitration and Conciliation Act, 1996 into an Application under Section 17 of the Arbitration and Conciliation Act, 1996 and move the same before learned Arbitrator, who has been appointed by this Court. 3.

Having due regard to the fact that the Court has already appointed an Areeb

2/2 9-CARBP-826-2024 (OS).DOC Arbitrator and the Respondent did not oppose, I am inclined to allow the Petitioner to convert the present Petition into an Application under Section 17 of the Arbitration and Conciliation Act, 1996 and move the learned Arbitrator for appropriate interim relief in terms thereof.
