Pursuant to order dated 23rd April 2025, today when the matter is called out, Ms.Anushka Jain, learned Counsel, appears for the Plaintiff and submits that despite service of Summons for Judgment, no reply has been filed nor any one appears for the Defendants today. That, on 23rd April 2025, the Defendants were represented and Vakalatnama has also been filed in the Summons for Judgment. Ms.Anushka Jain draws this Court's attention to Order 37 Rule 3 (6)(a) and submits that since no application for leave to defend has been filed, avk 1/2

17-COMSS-1-2025.doc the Plaintiff is entitled to a judgment forthwith and that this Court may make the Summons for Judgment absolute.

Ms.Jain also undertakes to file an appropriate Affidavit of service with respect to the service of the Summons for Judgment upon the Defendants.
