This petition has been filed by the petitioner seeking rectification of the registered trade mark of the respondent i.e. "ACKOOL".

It is brought to the notice of this Court that the petitioner and the respondent have executed consent terms, whereby the petitioner has agreed for restricted use of the registered trade mark by the respondent. The details are mentioned in the consent terms.

Today, Mr. Sudhir Budhrani, one of the Directors of the respondent, has joined the proceedings through video conferencing and he submits that the respondent is agreeable to BIPIN DHARMENDER PRITHIANI Date: 2025.01.14 10:54:40 +0530 BIPIN DHARMENDER PRITHIANI the terms specifically mentioned in the consent terms.

The consent terms tendered by the learned counsel for the petitioner are signed by the authorized signatory of the petitioner, as also the aforesaid Director of the respondent. The Advocate for the petitioner has also signed the consent terms. The consent terms are taken on record and marked 'X' for identification. 5.
Accordingly, the petition is disposed of as per the consent terms. A soft copy of the consent terms of the order shall be uploaded as the second order in the matter. The hard copy, duly signed by the parties, shall be retained in the record and shall not be sent for destruction in the usual course.

The undertakings given in the consent terms are accepted as undertakings given to this Court. The parties are directed to abide by their respective obligations as per the consent terms. MANISH PITALE, J.
