Interim Application has been preferred seeking release of the passport bearing No. Z1894618 of the Applicant who is ex-director of the company under liquidation as the passport has expired and the Application is required to be made to the passport Authority for reissuance of the new passport. 2.

Learned Counsel appearing for the Applicant submits that an undertaking will be given by the Applicant that immediately upon Shubham 1 of

19-(c)-IA-189-2025.doc re-issuance of the passport the same will be deposited with the Official Liquidator.

The said request is opposed by Mr. Sheth, learned Counsel appearing for the Official Liquidator submitting that it would be appropriate, if the Passport Authority are directed to forward the new passport to the Official Liquidator directly instead of handing over to the Applicant, considering the state of affairs. 4.

In my opinion the filing of an undertaking will not be sufficient to secure the presence of the Applicant. There are more than 150 company applications which are pending against company under liquidation in respect multiple projects which are stalled and have to be resolved on case to case basis. In order to secure the presence of the Applicant who is Ex-Director of the Company under liquidation it would be appropriate, if the Passport Authority is made party to the present Application.

The Applicant is directed to implead the Passport Authority as party to the present proceedings by amending the Interim Application. Amendment to be carried out within a period of one week from today.

List the matter on 10th July, 2025.
