This is Application filed seeking condonation of delay of 57 days in filing Commercial Arbitration Petition under Section 34 of the Arbitration & Conciliation Act, 1996 (the Arbitration Act). Under proviso to sub-section (3) of Section 34 of the Arbitration Act, the Court can condone the delay for maximum period of 30 days after expiry of usual period of 90 days. Arbitration Petition is sought to be filed after period of 90 + 30 = 120 days. In that view of the matter, delay in filing the Arbitration Petition cannot be condoned. Interim Application is accordingly dismissed.
