Heard Mr. Tulzapurkar, learned Senior Advocate for Applicant / Plaintiff and Mr. Seervai, learned Senior Advocate for Defendant.

Mr. Tulzapurkar prays for allowing Plaintiff - Society to amend prayer clause 13(a) in the suit plaint and prayer clause 18(c) in the Interim Application as the final four words in the interim prayer have been inadvertently missed out therein. He tenders Draft Amendment which is taken on record and marked as 'X' and 'X-1' respectively in the Suit & IA. Copies of the same are handed over to Mr. Seervai. After taking instructions, in his usual fairness, he submits that he has no objection for the said amendment to be allowed. 3.

In view of the above, Draft Amendments 'X' and 'X-1' stand allowed. Plaintiff is permitted to amend prayer clause 13(a) and prayer clause 18(c) in the Suit plaint and Interim Application. The said amendment is permitted to be carried out within a period of one week from today by the Advocate for Plaintiff. Re-verification stands dispensed with. Copy of the Suit plaint and Interim Application without its Exhibits shall be served upon Defendant afresh with the amendment.
