By order dated 07th March 2025, this Court had condoned delay of 271 days in filing the instant application. In the said order, it was specifically recorded that the Official Liquidator had raised an objection with regard to the entitlement of the applicant to claim as legal heir of Nareshkumar Chamanlal Shah. The said issue was kept open while delay was condoned and therefore, when this application is taken up for consideration, the learned counsel for the Official Liquidator reiterates the said objection. In that light, the learned counsel for the applicant seeks short adjournment to place an additional affidavit on record, in order to ensure that relevant documents are on the record of this application also to enable this Court to deal with the said objection raised on behalf of the Official Liquidator.

The additional affidavit alongwith documents be filed on or before 15th April 2025.

The Official Liquidator may file a response affidavit, if any, on or before 22nd April 2025.

List the application for further consideration on 25th April 2025, at 02:30 p.m.

By this application, the applicant is seeking re-adjudication of its claim to the extent its claim was rejected by notice of admission of proof dated 30th March 2021. The Official Liquidator shall file reply affidavit within two weeks from today.
