Having heard the parties, the fundamental opposition for making any deposit pending final hearing, is that the arbitrator has simply accepted an Expert's Report in arriving at the damages awarded in the Impugned Award.

Having heard the parties and having examined the relevant components of the arbitral award and the Expert's Report relied upon, it would be appropriate to direct that 50% of the amount awarded should be deposited with this Court, pending hearing and final disposal. Should such deposit be made within a period of six weeks from today, the execution of the arbitral award shall remain stayed. Default in making the deposit will result in there being no stay whatsoever on the execution.

All actions required to be taken pursuant to this order, shall be taken upon receipt of a downloaded copy as available on this Court's website.
