When the matter was called out, Ms. Chavan, Learned Counsel appearing on behalf of the Defendant made a grievance that Affidavit in Rejoinder has not been served upon her. She also submitted that the Caveats Mugdha

2 53-IA 1605-24.doc have been filed in the Interim Application which should be heard alongwith the present Interim Application.

On a perusal of the record, it appears that Affidavit in Rejoinder was not found. Furthermore, Learned Counsel for the Applicant could not show service of the same upon the Defendant.

Hence, at the request of Learned Counsel for the Applicant, stand over to 18 th February 2025.
