Heard the learned Counsel for the applicant.

This is an application for restoration of TP/1155/2021, which came to be dismissed pursuant to a common order dated 10th January, 2023.

The learned Counsel for the applicant submits that the common order would not govern TP/1155/2021. Without delving into the question as to whether the petitioner had complied with all office objections, and for the reasons assigned in the application and to advance the cause of substantive justice, the order dated 10th January, 2023 stands recalled qua TP/1155/2021.

TP/1155/2021 stands restored to file subject to the petitioner complying with the office objections, if any, within a period of six weeks from today.

In the event of default in complying with the office objections within the stipulated period, this order shall stand recalled and Testamentary Petition dismissed without further reference to the Court.
