This Interim Application seeks the following prayers : (a) Pass an order allowing the Applicants to sell and dispose of the Suit Property i.e. 28 flats in building no.16, Bandra Reclamation, MHB Colony, K.C. Road, Bandra (West), Mumbai - 400 050 with 20 covered car parking spaces.

40-IA-1689-2025.doc (b) Pass an order vacating or modifying the interim reliefs granted by this Hon'ble Court by way of the Order dated 16th may 2008 in Notice of Motion No.1676 of 2008 (as partially modified by the Order dated 7th February 2018 in Notice of Motion No.1676 of 2008 and Notice of Motion No. 374 of 2010).

When the matter is called out, Mr. Mohan, learned Counsel, appearing for the Applicants submits that there is a Suit No.1423 of 2008 where the Applicants are the Defendants No.1 and 3, hearing of which Suit has been expedited in view of the Judgment dated 25th June 2025 passed in Writ Petition No.1997 of 2007. 3.

Upon a query from this Court, as to whether in the light of the order expediting the hearing of the Suit, the Applicants would withdraw the Interim Application filed seeking the aforesaid directions, Mr. Mohan seeks some time to take instructions. 4.

At his request, list on 3rd October 2025.
