INTERIM APPLICATION NO.1788 OF 2024 The present interim application has been filed to expedite fixing the date for recording evidence in the caption suit. The reasons set out in the interim application are that the applicant is a senior citizen and defendant no.1 is also the senior citizen of 81 years of age. In fact, the application sets out that even the witnesses are all super senior citizens and thus the hearing of the suit be expedited.

The affidavit in reply does not controvert this position, however raises several other grounds of suppression as also adverse to various other legal proceedings that have been filed. The same would not, in my view, come in the way of allowing the present interim application. Interim application is therefore, allowed and accordingly disposed of in terms of prayer clause (a). th March 2025.
