This Interim Application has been filed seeking amendment to the Execution Application by the Decree Holder. 2.

Ms. Krishnappa, learned Counsel for the Claimant, on instructions, seeks liberty to delete description of the property which has been mentioned in SCHEDULE "A" at Sr. Nos. 2 & 3. She is also seeking to amend pin code of Mumbai at Sr. No. 1. 3.

Liberty as sought for to delete description of the property as mentioned at Sr. Nos. 2 & 3 in SCHEDULE "A" on page No. 14 of the Interim Application is permitted. So also the Claimant is permitted to Anand

327. IA 2482-2024.doc change pin code of Mumbai at Sr. No. 1. Amendment be carried out forthwith.

I have heard learned Counsel for both the sides. I have also gone through the contents of the amended Interim Application and reply filed therein.

I am convinced that this Interim Application deserves to be allowed subject to the rights of the Respondents be kept open as regards to the Respondents disputing the properties mentioned in SCHEDULE "A" are not their properties.

The Interim Application stands allowed in terms of prayer clause (a).

6.1.

It is made clear that the rights of the Respondents as regards their submissions that the properties which are now mentioned in SCHEDULE "A" will be added in the Execution Application are not their properties are open.

7.

Amendment to be carried out in the Execution Application two weeks from today.
