This Interim Application filed on behalf of Defendants no.1, 3 and 4 seeks condonation of delay of 88 days in filing the Applicants' ARTI VILAS KHATATE written statement.

When the matter is called out, Mr.Moorjani, learned Counsel appearing for the Plaintiff, submits that in view of paragraph 18 of the Partial Consent Terms dated 10th November 2025 where the Plaintiff has granted no objection to the Interim Applicant, the Interim Application be allowed and the written statement be taken on record. 3.

Having heard the learned Counsel for the Applicants and also the learned Counsel for the Plaintiff and with their able assistance having perused the Interim Application as well as paragraph 18 of the Partial Consent Terms, this Court is of the view that the Interim Application be allowed as prayed for.

The delay of 88 days is hereby condoned.

Registry to accept the written statement dated 28th August 2024 on behalf of the Defendants no.1, 3 and 4.

The Interim Application accordingly stands allowed and disposed as above.

INTERIM APPLICATION NO. 2987 OF 2024 7.

This Interim Application filed on behalf of Defendant no.5 seeks condonation of delay of 89 days in filing the Applicant's written statement.

Mr.Karl Tamboly, learned Counsel appearing for the Respondents no.1 to 4 submits that reply as well as additional reply have been filed and served and that this Court may direct the Registry to accept the additional reply. Registry to accept the same. 15.

Ms.Meena Ruparel, learned Counsel appearing for the Respondent no.5 also seeks some more time to file a reply. Let the reply be filed within a period of two weeks with copy to the other side. 16.

Mr.Moorjani, learned Counsel appearing for the Applicant, seeks some time to file a rejoinder. Let the rejoinder(s) be filed in within a period of three weeks with copy to the other side. 17.
