IN THE HIGH COURT OF JUDICATURE AT BOMBAY

TESTAMENTARY AND INTESTATE JURISDICTION INTERIM APPLICATION NO.2952 OF 2024 IN TESTAMENTARY PETITION NO.2455 OF 2024 Ashutosh Jayantilal Vyas ...

Applicant/Petitioner Kirty Ambalal Dave ...

Deceased Ms. Manisha Virkhare with Mr. Nandkishor Supal i/by Divya Shah Associates, for Applicant.

CORAM: N.J.JAMADAR, J.

DATE :

9 OCTOBER 2024 P.C.

1.

Heard the learned Counsel for the Applicant.

2.

This is an application for post grant amendment in the Probate of the last Will and Testament of Kirty Ambalal Dave, granted by an order dated 9 August 2024.

3.

In the application, it is averred that in the cause title of the Petition, it was inadvertently incorrectly mentioned that the deceased was a person of Indian origin and a citizen of USA, instead of Indian Inhabitant of Mumbai. Hence, this application.

4.

I have perused the averments in the applicant and the documents annexed to the Testamentary Petition. The proposed amendment appears to be in the nature of correction of an inadvertent error in mentioning the citizenship of the deceased.
