When the matter is called out, the learned Court Associate has drawn this Court's attention to the service report of the bailable warrant of arrest dated 20th August 2025.

Perusal of the report indicates that the Police Officials of the said Police Station had visited the address of Respondents No.2 and 3 situated at A/1307, Golf Scappe, Sunny Estate, Sion Trombay Road, Chembur, Mumbai, however, the Respondents were not found at the said address and upon making enquiry with Mr. Gaurav Kalara, who Kanchan Dhuri 1/2

33-IA-3130-2024.doc was staying on rent at the aforesaid address it was informed that Mr. Vishwanath Narayan Shetty is the owner of the said flat. That the police officials contacted Mr. Vishwanath Narayan Shetty on his mobile when it was revealed that he had purchased the said flat from Bank of India and he did not have any information regarding the Respondents. It has been stated in the said report that the bailable warrant issued against the Respondents No.2 and 3 is returned unexecuted. 3.

Ms. Gogri, learned Counsel, appearing for the Applicant seeks some time to take instructions in the matter. 4.

Let instructions be taken by the next date.
