This Interim Application seeks expedition of the Suit. 2.

When the matter is called out, Mr.Jayesh Mestry, learned Counsel appears for the Applicant / Plaintiff and submits that this Suit is connected with two other Suits viz. Commercial Summary Suit No.7 of 1999 and Suit No.3813 of 2000 in which this Court has commenced with the marking of documents. Mr.Mestry submits that in this Suit as well this Court may proceed to mark the documents, in as much as, the Statement of admission and denial of the Defendant had already been ARTI VILAS KHATATE avk 1/2 by ARTI VILAS KHATATE Date: 2025.08.26 20:57:33 +0530

This order has been corrected/modified by order dated 26th August 2025 6-IA-3195-2025.doc filed. Mr.Mestry draws this Court's attention to order dated 16th March 2002 where it has been directed that this Suit be heard along with Summary Suit No.4870 of 1999 - later converted into Commercial Summary Suit No.7 of 1999 and Suit No.3813 of 2000. 3.

Ms.Neuty Thakkar, learned Counsel, appears for the Defendant and submits that this Suit be proceeded along with the other two Suits. 4.

List this Suit along with Commercial Summary Suit No.7 of 1999 and Suit No.3813 of 2000 on 26th August 2025 under the caption 'for directions'.
