When the matter is called out, Mr. Mestry, learned Counsel appears for the Plaintiff in Suit No. 305 of 2001 and submits that affidavit in lieu of examination-in-chief of the Plaintiff has been filed and served along with affidavit and compilation of documents. That the Nikita Gadgil 1/2

40. S 305-01 @ connected matters.doc marking of the Plaintiff's documents in Commercial Summary Suit No. 7 of 1999 and Suit No. 3813 of 2000 is under way and this Court may proceed with the same. That after the marking of the documents in those two Suits, this Court may consider marking of the documents in Suit No. 305 of 2001.

Mr. Shah, learned Counsel appearing for the Plaintiff in Commercial Summary Suit No. 7 of 1999 and Suit No. 3813 of 2000 submits that there are about 20 documents in Suit No. 3813 of 2000 and 6 documents in Commercial Summary Suit No. 7 of 1999 for marking of the documents.
