The above Interim Application is filed to set aside and/or to recall the Order dated 11th June, 2024 passed in the above Writ Petition by another Division Bench of this Court, dismissing the Writ Petition for nonprosecution. 2.

Having heard the learned Advocate appearing on behalf of the Petitioner as well as the learned Advocate appearing on behalf of the APRIL 01, 2025 S.R.JOSHI

7-ia-3212-2024.doc Respondent, we are satisfied with the explanation given for not appearing before this Court on 10th June, 2024 and 11th June, 2024. 3.

In these circumstances, the above Interim Application is allowed in terms of prayer clauses (a) and (b) which read thus:- "(a) That this Hon'ble Court may be pleased to set aside the order dated 11th June, 2024 for dismissal for default of the above Writ Petition and Interim Application therein bearing no. IA/2582/2023 passed by the Division Bench of His Hon'ble Judges Shri K. R. SHRIRAM & JITENDRA SHANTIAL JAIN be set aside and the above Writ Petition and Interim Application be restored to file; (b) This Hon'bel Court may be pleased to condone the delay, if any, in filing the present Application." 4.

The Interim Application is disposed of in the aforesaid terms. However, there shall be no order as to costs. 5.
