Heard the learned Counsel for the applicant.

This is an application to amend the Letters of Administration to the property and credits of Cyrus Russy Gandhy, the deceased, granted by an order dated 19th December, 2023. In the Schedule of Assets at Sr. No.11 and locker bearing No.2178 maintained with Bank of India was included, though it stands in the joint names of the deceased and Indrani Gandhy, with the mandate of "either or survival". Hence, the applicant seeks leave to amend the application to delete the said item from the Schedule of Assets. 1/2

The application is supported by a communication dated 4th July, 2024 addressed on behalf of the Bank of India (Exhibit-B). Thus, I do not find any impediment in allowing the application.

(i) Application stands allowed in terms of prayer clause (a). (ii) Necessary amendment be carried out within a period of two weeks from the date of the uploading of this order (iii) Post amendment grant expedited.
