Mr.Gauraj Shah, learned Counsel for the Applicant, mentions the matter for extension of the statement made on behalf of the Respondent no.4 recorded in order dated 5th January 2026 that the Respondent no.4 or any of his family member will not create any third party interest or part with possession of the property referred to in the schedule to the Execution Application which has been withdrawn, for a period of four weeks, by a period of one more week, submitting that some more time be granted to avail of the liberty granted vide the said order to put the house in order.

Mr.Goghari, learned Counsel, appears for the Respondent no.4 and submits that four weeks have already expired two weeks back and the Applicant cannot come like this and ask for extension of the statement made on behalf of the Respondent no.4. 3.

Upon a suggestion from this Court to Mr.Goghari to take instructions from his client as to whether the statement can be extended for one more week from today, Mr.Goghari has taken instructions from his client, the Respondent no.4, who is present in Court and submits on instructions that discussions are going on and the avk 2/3

formalities will take place in early March, however, this Court may extend the statement only by one more week. Statement is accepted. 4.

In view of the above, the statement made in paragraph 7 of the order dated 5th January 2026 is extended by a period of one week from today.

The praecipe accordingly stands disposed.
