Interim Application No.3554 of 2025 :

Mr. Tervankar, learned Counsel, appears for the Applicant and submits that this Interim Application seeks substituted service upon the Respondent No.1 as the Respondent No.1 could not be served by the ordinary mode on the existing address and the packets have been returned with the remarks 'insufficient address'. Having heard the learned Counsel and having considered his submissions, I am of the view that the Interim Application for substituted service be allowed in terms of prayer clause (a), which reads thus :

a.

This Hon'ble Court be pleased to allow the Applicants to serve the Respondent No.1 by publishing a notice/order preferably in daily i.e. Free Press Journal and Navshakti newspaper in English and Marathi language widely circulated in the vicinity of Maharashtra State by way of the substitute service as per Order 5 Rule 20 and other provisions of Civil Procedure Code, 1908.

Let the publication be effected in terms of prayer clause (a) as above, within a period of four weeks and let an appropriate Affidavit of service be filed by the next date.

The Interim Application No. 3554 of 2025 stands allowed and disposed as above.
