TESTAMENTARY AND INTESTATE JURISDICTION INTERIM APPLICATION NO. 3647 OF 2024 IN TESTAMENTARY PETITION NO. 1788 OF 2023 Dr Neelam Vinod Ahuja ...Applicant/Petitioner Jagjit Kaur Avtar Singh Gill ...Deceased ---- Ms Madhuri Gaikwad i/b M G Legal for Applicant/Petitioner. ---- CORAM : ARIF S. DOCTOR, J.
th MARCH 2025 DATED : 27 P.C. :
The present interim application seeks a post grant amendment to the schedule of the properties and credits stated to be belonging to Jagjit Kaur Avtar Singh Gill, who passed away on 27 th August 2012. This court had vide order dated 17 th April 2024 granted the applicant letters of administration to the properties and credits of the deceased. The learned counsel for the applicant pointed out that it was only after the receipt of the letters of administration that the applicant noticed that in the Schedule-1, it was inadvertently mentioned in the first line of Item No.1 that the share of the applicant was 1/3rd, whereas the same should be 6/15 th. Since the interim application did not clearly set out the basis on which the applicant claimed to be entitled to 6/15 th Share, the applicant was directed vide order dated 13 th March 2025 to set the same out.
The Applicant has since filed a further affidavit dated 22 nd March 2025, in which the same has been sufficiently explained and having due regard to the Meera Jadhav
2/2 13-ia-3647-24.doc submissions made, as also what is stated in the said further affidavit, the applicant has shown sufficient cause for the interim application to be allowed. Hence, the interim application is allowed in terms of prayer clause (a) which reads as under: "(a) The Applicant be allowed to carry out the amendment in the Schedule I in the Petition and in the Letters of Administration as per the Proposed Amendment at Exhibit B."
Amendment to be carried out within a period of two weeks from today. Interim application accordingly stands disposed of. (ARIF S. DOCTOR, J.) Meera Jadhav
