Pursuant to order dated 9th January 2025, today when the matter is called out, as soon as Mr.Shah, learned Counsel for the Applicant has commenced his arguments in the Notice of Motion, Mr.Dave, learned Counsel appearing for the Defendants submits that there is an Interim Application seeking to amend the written statement that has been filed and that the same be heard before the Notice of Motion is heard. avk 1/2

Mr.Shah, learned Counsel for the Applicant, submits that if that be the case, time be granted to file reply.

Upon a suggestion from the Court to Mr.Shah whether the Notice of Motion can be disposed of as there does not appear to be any imminent intention of the Defendants to create any third party rights, Mr.Shah would submit that the Defendants may give two weeks notice before any such steps are taken. Mr.Dave seeks some time to take instructions. Let instructions with respect to the Notice of Motion be taken by the next date. Registry to accept the reply in the Notice of Motion.

Accordingly, list on 27th February 2025.
