The principle contention of learned counsel for the Applicant is the nonpayment of the arbitrator's fees on the ground that the ex-director of the Company in Liquidation, namely Mr. Ashok Patil, had given a solemn undertaking to make such payment. It is also recorded in the order dated 6 th January 2017 that the ex-director has also filed an affidavit in reply contesting these proceedings. However, he is not present today, nor is any advocate appearing on his behalf.
